Terms of Service

These Terms govern your access to and use of the Gentoo website and software (the “Service”). By using the Service, you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm that you have authority to bind it.
1. The Service
Gentoo provides crew-operations software for expedition and polar cruise operators, including crew records, compliance, scheduling, travel, and a documentation assistant. We may add, change, or remove features over time.
2. Accounts
Access to the product is provided through your operator. You are responsible for keeping your login credentials secure and for activity that happens under your account. Tell us promptly if you suspect unauthorised use.
3. Acceptable use
- ·Use the Service only for lawful purposes and in line with these Terms.
- ·Do not attempt to break, probe, or interfere with the Service or its security.
- ·Do not upload content you do not have the right to share, or that is unlawful or harmful.
- ·Do not use the Service to build a competing product.
4. Customer data
Your operator owns the data it puts into Gentoo. We process that data only to provide the Service, in line with our Privacy Policy and any agreement with the operator. We do not claim ownership of customer data.
5. Intellectual property
Gentoo, including the software, design, and brand, is owned by us and our licensors. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service as intended.
6. Demos and early access
Demos, pilots, and pre-release features are provided for evaluation and may change or be withdrawn. Anything shown in a demo, including sample vessels, crew, and data, is illustrative and not real operational data.
7. Disclaimers
The Service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose. Gentoo supports your compliance work but does not replace your own legal and regulatory responsibilities; you remain responsible for the operational decisions you make.
8. Limitation of liability
To the maximum extent permitted by law, Gentoo will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for it in the twelve months before the claim arose.
9. Termination
You may stop using the Service at any time. We may suspend or end access if these Terms are breached or if it is necessary to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.
10. Governing law
These Terms are governed by the laws of British Columbia, Canada, without regard to its conflict-of-law rules. The courts located in British Columbia will have exclusive jurisdiction, unless a signed agreement with your operator states otherwise.
11. Changes
We may update these Terms. When we make material changes, we will update the date above. Continued use of the Service after changes take effect means you accept the updated Terms.
